Breast implant health scare: am I entitled to compensation?
As you may have seen in the news, thousands of women in the UK are struggling to cope with the agony of living with faulty breast implants.
Manufactured by the now-defunct French cosmetics company PIP, they were made using industrial-grade silicone and many women with the implants have discovered, to their horror, that they become damaged through leaking and rupturing.
Many women whose implants have malfunctioned are angry, scared and confused as a result, and don’t know what’s going to happen next. Having breast implants can cost thousands, and if they fail, the cost of removing them is potentially even greater.
If you’ve had faulty PIP implants which have ruptured, leaked or even exploded, you will feel that you’re entitled to some form of compensation to cover the cost of having them removed and living with any other health issues that arise from them. However, knowing whether you have a case is a different issue.
You have a case to make a claim if you’ve experienced any problems which have adversely affected your health or ability to work. In extreme cases, some women with the implants have got cancer, which has been linked to the implants, while others have been told by doctors and other health professionals that their implants are safe for tasks such as breastfeeding, only for the implants to become damaged in the process afterwards.
PIP ceased to exist towards the end of 2011 in the wake of the implant crisis, and responsibility for fitting the implants does lie with those who performed the operations. Fortunately, you can still make a claim against PIP, which, if successful, can get you compensation in excess of £100,000.
