When a work-related respiratory issue such as lung disease, occupational asthma, asbestosis or mesothelioma occurs, it often leaves a lasting mark on quality of life. And if it has come about even though you're guilty of nothing but working hard, it can be difficult to take. That's why we'll fight to get you the compensation you deserve.
The Health and Safety Executive also reports that, each year, some 12,000 people die from occupational respiratory disease, with two in three related to asbestos or chronic obstructive pulmonary disease (COPD). If you've been affected by respiratory issues caused by work, you'll be pleased to hear you can make a compensation claim.
What are industrial respiratory issues?
There are a number of respiratory diseases that are often caused by poor working conditions, including: asbestosis, occupational asthma, lung disease and mesothelioma.
As the name suggests, involves asbestos, something that many in the construction industry have worked with. It arises from breathing in asbestos fibres and can lead to:
- Finger clubbing (finger deformities)
- Heart disease
- Reduced tolerance of exercise
Caused by things such as car spray painting, cleaning with chemicals, welding and working in the manufacturing of plastics and textiles. Symptoms include:
- Progressive deterioration in breathing during the working week
- Disturbed sleeping patterns
- Development of associated illnesses like rhinitis and conjunctivitis
Comes in many forms. Asthma, silicosis, COPD, allergic alveolitis, mesothelioma and asbestosis are all classed as lung diseases. In general, they all involve:
- Reduced ability to breathe normally
- Shorter lifespan
- Gentle activities becoming a struggle
This is a type of cancer that is usually connected to respiratory issues. However, while the majority of cases develop in the lungs (pleural mesothelioma), it can also occur in the abdomen (peritoneal mesothelioma). Associated with exposure to asbestos at work, the mesothelial cells, which cover the outer layer of most internal organs, mutate and become cancerous. In instances of pleural mesothelioma, there is a chance the cancer can spread to the heart. While treatment is possible, the disease is virtually incurable. Symptoms include:
- Shortness of breath
- Chest pain
Who can I claim against?
For all cases of industrial respiratory diseases, the one to claim against is the employer. They're responsible for ensuring that you are safe at work and part of their role should involve giving all employees the relevant safety equipment. Failure to do so makes them liable if a worker develops breathing difficulties.
You could claim as much as £92,820 for lung cancer caused by asbestos. Claims for mesothelioma are usually awarded between £61,410 and £110,380. Make sure to check our Compensation Guide if you’re suffering from a different respiratory disease and you want to see how much you could claim for. When can I make a claim?
It's best to do it as close as possible to when you start developing symptoms or receive an actual diagnosis. Even if it has been a while, we should still be able to help.
