There were 6.83 billion passenger journeys in 2017/18, according to the Department of Transport. And that doesn’t include journeys by air, taxi or lifts from family and friends.

When can you make a passenger injury claim?

If you were injured while a passenger in a vehicle, did you know you could have the right to claim?

Drivers have a legal obligation to ensure your safety when you are a passenger in their vehicle – whether they are a bus driver, taxi driver, tram driver or a friend.

For example, if a child under the age of 14 is injured and they weren’t wearing a seat belt, the driver is responsible as they didn’t ensure the child’s safety.

If the person driving was at fault, or the driver of another vehicle if it was a collision, you could claim from their insurer.

More about making a claim

What if the driver has no insurance?

If the driver responsible for your accident was driving without insurance, you can still make a claim.

The Motor Insurers’ Bureau (MIB) helps with accidents where you are unable to claim from the insurer of the driver at fault, such as where there is no insurance and where a driver leaves the scene of an accident.

Claiming against a friend or family member

People can be understandably worried if the driver at fault is a friend or member of your family.  However, a compensation claim will be paid by the insurer, so it doesn’t come straight out of a loved one’s pocket!

How can First4Lawyers help?

Our legal advisors are here to talk you through what happened and tell you whether you are likely to have a claim.

If you do, and you want to proceed, we will refer you to a solicitor specialising in road traffic accidents like these.

They will explain what they need in order to submit a claim, including any information they need in order to put together all the supporting evidence.

They will also tell you whether you are eligible for our No Win No Fee* service.

You can then concentrate on receiving treatment and recovering.

About No Win No Fee

Only pay a fee if you receive compensation

Where we offer No Win No Fee services typically customers pay 25% of the amount recovered by our solicitors, although this will be subject to your individual circumstances and the actual fee may be less than this but it will never be more. Success fees are common practice and they were introduced when the law changed in April 2013.

How much compensation will I receive for a passenger accident claim?

That very much depends on your injuries and how severe they are. As an example, whiplash tends to result in payouts up to £3,810.

Our compensation calculator gives an idea of the amounts you could be awarded, but a chat with our legal advisors will give you advice tailored to your individual circumstances.

Is there a time limit for making a claim?

You must make a claim within three years of the accident taking place.

I think I have a claim, what do I do next?

Make sure you get medical attention promptly and tell them about the accident so that it’s added to your medical records.

Photographic evidence is useful if you have it, as well as the insurance details of the person at fault.  If there were any witnesses, or fellow passengers, their statements would also be very helpful.

Many people nowadays use dash cams, providing a valuable source of evidence when making a claim.

If you were a passenger in a taxi, try to gather details such as the cab firm, driver’s name and number.

All that aside though, just get in contact with us.  We will talk you through what happened and, if you are eligible to make a claim, we’ll explain the process.  You can then decide whether you want to go ahead.
