First successful payout for ‘toxic sofa’ victim:

A pensioner from the West Midlands has become one of the first 'sofa rash' victims to receive a payout. He purchased the sofa in November 2007 from Furniture Warehouse in Dudley and began suffering from the rash within days. He has now received a four-figure compensation payout along with a full refund of the £1,100 sofa.

There are believed to be thousands of people who have suffered similar allergic reactions, with many not knowing of a possible link between their rash injuries and their sofa. Last year, Argos recalled about 30,000 of the leather sofas they had sold and offered many customers refunds.

Sofa Rash Group Litigation Order:

At the latest High Court hearing in London, lawyers acting on behalf of some of the victims were trying to agree compensation terms for what is believed to be the largest group compensation claim in British courts.

On the 6th June 2008 at the Nottingham Crown Court hearing the judge decided to allow a Group Litigation Order to go ahead - allowing anyone who has suffered effects of the faulty/toxic sofas to become part of the case. The order ensures that all the cases will be dealt with collectively. You may have seen the story and various advertisements explaining the problem which have appeared in many newspapers recently.

The story first appeared in the News of the World on 9th September 2007 (and later on BBC's Watchdog programme) which reported that the Pia and Bari sofas may have caused the skin rash problems, which appear as severe redness, itching and in some cases blistering. Several people have received hospital treatment for the skin rash from the toxic sofas and some have developed dermatitis, which is a severe inflammation of the skin similar to eczema. Argos and Land of Leather are said to have now withdrawn the toxic leather sofas from sale.

Causes of Sofa Rash:

Dermatology experts are carrying out tests to determine which chemicals are causing the skin rashes and how the chemicals got onto the sofas. Early reports have suggested that a sachet which is placed in the sofas and contains a chemical called Di-methyl Fumarate (DMF) is causing the skin irritation. The sachet is supposed to stop the sofas going mouldy during storage and everday usage, but when exposed to heat the sachets release a toxic gas which passes through clothes and causes the sofa rash symptoms.

From May 1st, the chemical DMF has been banned from use in any products which are imported into the EU.
