What is a liposuction compensation claim?

Liposuction is the removal of fat from the body through a suction tube. Classed as cosmetic surgery, it is typically carried out on someone with excess fat in certain parts of the body. It is not typically carried out for general weight loss.

It is an increasingly common procedure, with 2,518 people undergoing it in 2018 in the UK. This was an increase of 9% from 2017.

However, as with all surgical procedures, there is the potential for it to go wrong. A botched liposuction could lead to injuries and other issues including:

  • Excessive scarring requiring further surgery to minimise
  • Infection
  • Organ damage
  • Anaesthetic problems
  • Excessive bleeding
  • Deep vein thrombosis

If you have suffered an injury as a result of a botched liposuction, you could make a cosmetic surgery negligence claim for compensation.

Why should I make a liposuction compensation claim?

Compensation is awarded to cover the pain and suffering you have experienced as a result of medical negligence. It is intended to get you back in the position you were in before the injury. It can help you pay for any treatment you need to aid your recovery, as well as any other expenses related to your injury.

You may not be able to work after suffering from liposuction negligence. A successful claim for compensation will help make up for any loss of earnings.

Is there a time limit for making liposuction compensation claims?

In most cases of medical negligence, you have three years to make a compensation claim. However, if you suffered an injury that you didn’t realise was because of your liposuction until after that period, you could still make a claim.

This is because you can claim up to three years after discovering that your care was negligent. This is known as the date of knowledge.

If you’re claiming on behalf of someone who lacks the capacity to claim for themselves, you won’t face a time limit unless they regain capacity.

How much will I receive in compensation?

Your case is unique to you. There are a number of factors that have to be considered when deciding on a compensation amount. This means that it is difficult to say exactly what you might be entitled to without an initial consultation.
