Whether you’re a livestock farmer, arable farmer or both, you’ll know there are many dangers to watch out for.  According to the Health & Safety Executive (HSE), there were 33 fatal injuries and 816 non-fatal injuries across the farming industry (PDF)  in 2017/18.

They also say: “In the last decade, almost one person a week has been killed as a direct result of agricultural work. Many more have been seriously injured or made ill by their work.”

Types of farming accident?

Following Health and Safety is an essential part of farming, to ensure workers are protected.

The Management of Health and Safety at Work Regulations 1999 require that all employers or the self-employed assess their own risk, and the risk to anyone working for them regarding their working environment. The law requires you to take all reasonably practicable steps to avoid accidents in the workplace.

Injuries are often caused by:

  • Slips, trips or falls
  • Animals
  • Falling from height
  • Being struck by moving or falling objects
  • Contact with machinery
  • Handling, lifting and carrying
  • Being hit by a vehicle

As well as the risk of accident while using farm machinery and vehicles, the farming workplace can contain confined spaces like fuel storage tanks, grain silos and slurry pits. These can present numerous risks that include drowning, asphyxiation and toxic gases.

Why make an agriculture and farming accident claim?

If you’ve been injured while doing farming or agricultural work, or even when visiting a farm, you may be eligible for compensation.

If proper health and safety procedures were not followed on the premises, then it may be negligence that contributed to, or caused, your injury.

A financial settlement can help with costs such as treatment, ongoing therapy, loss of wages and travel to medical appointments.  It can also pay for equipment or mobility aids you might need during your recovery. More about making a claim

How can First4Lawyers help?

Our accident at work specialists are very experienced in these types of claim.  They will build a case that helps you achieve maximum compensation.  We also offer a No Win No Fee* service.

About No Win No Fee

Only pay a fee if you receive compensation

Where we offer No Win No Fee services typically customers pay 25% of the amount recovered by our solicitors, although this will be subject to your individual circumstances and the actual fee may be less than this but it will never be more. Success fees are common practice and they were introduced when the law changed in April 2013.

How much compensation will I receive for a farming injury?

It’s hard to give precise figures, as it depends on your individual case and the severity of your injuries.  Our compensation calculator gives ranges and amounts recommended by Judicial College Guidelines, but a chat with our legal advisors will give you advice tailored to your individual situation.

Is there a time limit for making a claim?

You normally have three years from the date of the accident to make a claim.

I think I have a claim, what do I do next?

You will need to seek medical attention for treatment and to make sure the injuries are noted in your medical records.

Then just get in touch with us for a free consultation.  We’ll ask you about the accident and your injury, then advise you of your options.
