What is a hit and run accident?

Each year, thousands of people are injured or killed by drivers who fail to stop at the scene of an accident.

Under Section 170 of the Road Traffic Act 1988, drivers have “a duty to stop, report an accident and give information or documents”. Failing to do so is a criminal offence.

While some drivers flee the scene because they are scared or over the legal alcohol or drug levels, many also drive off because they are not insured.

But did you know you still may be able to claim compensation if you've been hit by someone who failed to stop?

When can you make a hit and run claim?

The Motor Insurers’ Bureau (MIB) is an organisation that has agreements with the Government to cover those situations where:

  1. A driver was found to have no insurance
  2. A driver could not be traced at all

A proportion of all car insurance policies goes towards funding MIB claims.

If you have been injured, you must report the accident to the police within 14 days or as soon as reasonably possible. A claim must be submitted to the MIB within three years of the accident.
